Eligibility

You May Qualify for low-cost representation if:

  • Your household income is at or below 150% of federal poverty guidelines for your household size; AND
  • You are actively in removal proceedings in the Kansas City Immigration Court
  • You May Qualify for pro bono representation if:
  • Your household income is at or below 150% of federal poverty guidelines for your household size; AND
  • You are actively in removal proceedings in the Kansas City Immigration Court; AND
  • You or a qualifying relative* is/are legally disabled; or
  • You or a qualifying relative* currently or used to serve in the U.S. military; or
  • You are currently living in a domestic violence shelter
    *qualifying relative is defined as a parent, an unmarried child, or a current spouse who is a U.S. citizen or lawful permanent resident

You do not qualify for low cost or pro bono services if ANY of the following apply:

  • Your household income is above 150% of federal poverty guidelines for your household size; or
  • You are not actively in removal proceedings with the Kansas City Immigration Court*; or
  • You already have a final order of deportation; or
  • You already have an order for voluntary departure; or
  • Your removal case has been completed, closed, or terminated; or
  • You have a Notice to Appear (NTA) from the Department of Homeland Security BUT it has not yet been submitted to the Kansas City Immigration Court*

*EXCEPTIONS: Even if your case has not yet been filed with the Immigration Court, you may remain eligible for a consultation with The Clinic’s attorney if either:

  1. you are detained in Kansas or Missouri by ICE [not criminal custody] and have not been ordered deported or ordered to take voluntary departure; or
  2. you are a minor who might qualify for Special Immigrant Juvenile Status.

How to tell if your NTA has been submitted to the immigration court:

  • Go to the EOIR online Automated Case Information page here, enter your alien number (A#) and click “submit.”
  • If your case has been filed with the immigration court, your hearing date and time will appear on the screen. If, instead, you see the message “No case found for this A-Number,” your case has not been filed with the court, and you are not in removal proceedings.
  • Alternatively, you can call the EOIR automated court information system (1800-898-7180) and follow the instructions
  • Once you enter your A#, if the recording says “the A number information you entered did not match a record in the system, or the case has not been filed with the immigration court”, then you are not yet in removal proceedings.

If this is the case, we recommend checking the website or calling the EOIR 1800# every week or two to ensure that you still have not been placed in proceedings and have not missed a hearing date.

Required Documents

  • 3 most recent pay stubs from you and every person in your household who has a job.
  • If anyone is paid cash, then we need a notarized letter from the employer (preferably on letterhead), describing: the person’s job title, how many hours per week they work, and how much they are paid per hour (or per year – pre-tax – if it’s a salaried position).
